Terms & Conditions
By purchasing a ticket to PRIME: Build Your Baseline (the “Event”), presented by The Wellness Club (the “Event Host”), you agree to the following terms and conditions:
1. Event Participation & Assumption of Risk
The Event includes physical wellness and recovery experiences such as cold plunge, sauna, movement classes, and recovery equipment (the “Activities”). Participation in these activities is voluntary and may involve inherent risks including but not limited to physical injury, illness, allergic reactions, death or other health-related conditions (the “Risks”).
By attending the event, you confirm that you understand the Risks and are in suitable physical condition to participate in the Event and are doing so voluntarily at your own risk. You acknowledge and agree that you will follow all safety instructions provided by the Event Host, their staff, agents or affiliates.
All attendees will be required to acknowledge and agree to an event waiver prior to participating in any wellness or recovery activities and certain experiences may require additional consent or screening on site in the sole an unfettered discretion of the Event Host or its agents or affiliates (the “Waiver”).
2. Medical Disclaimer
The Wellness Club does not provide medical advice. Event experiences are for educational and experiential purposes only and are not a substitute for professional medical guidance and the Event Host is not making any representations express or implied with respect to the Activities or any information provided.
If you have any medical conditions, injuries, or concerns, please consult a qualified healthcare professional before participating in the Event or any Activities.
3. Tickets, Refunds & Transfers
All ticket sales are final.
Tickets are non-refundable.
Tickets may be transferred to another attendee up to 48 hours before the event, subject to availability and Eventbrite’s transfer process.
Each ticket grants access to one session only.
4. Event Changes & Force Majeure
The Event Host reserves the right in their sole and absolute discretion without liability to modify the event schedule, sessions, speakers, or experiences if necessary or as they deem appropriate. In the event of unforeseen circumstances beyond our control, including but not limited to pandemic, epidemic, war, unrest or riots, acts of God, weather, venue issues, or public safety concerns, the event may be rescheduled or adjusted without refunds or liability to the Event Host.
5. Code of Conduct
All attendees are expected to behave respectfully toward staff, instructors, vendors, and other guests. The Event Host reserves the right in their sole and unfettered discretion to remove any attendee whose behavior is deemed unsafe, disruptive, or inappropriate, without refund.
6. Photography & Media Release
By attending the Event, you grant permission for photographs, video recordings, or other media taken during the Event to be used for promotional, marketing, advertising, and social media purposes, without compensation or notice and waive any intellectual property rights including but not limited to copyright and moral rights which may be associated with the use of my likeness and that my likeness may be used in any manner deemed fit by the Event Host, its affiliates, agents or contractors.
7. Marketing Communications
By purchasing a ticket, you consent to receive event-related and marketing communications from the Event Host, including follow-up emails about the event, future events, programs, and membership opportunities.
You may unsubscribe from marketing communications at any time.
8. Acceptance of Terms
By purchasing a ticket and/or attending the Event, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
9. Limitation of Liability
The Event Host shall have no liability whatsoever as it relates to the Event, the Activities or the Indemnified Matters. The user of this ticket shall be prohibited from seeking any damages, costs, awards, judgments, orders, equitable relief or such other remedies that a court of competent jurisdiction may grant the undersigned and that the Event Host shall be entitled to plead this waiver as estoppel. In the event that this provision is deemed unenforceable, the maximum amount of damages of the Event Host shall be limited to the price of this ticket exclusive of any applicable tax or service fees.
10. General Terms
You acknowledge that you have read and understood this waiver, and you agree that it is binding upon me and my heirs, executors, administrators, and legal representatives.
Each of the provisions contained in these terms and conditions is distinct and severable and a declaration of invalidity or unenforceability of any such provision or part thereof by a court of competent jurisdiction shall not affect the validity or enforceability of any other provision hereof.
The parties acknowledge and agree that any rule of law providing that ambiguities shall be construed against the drafting party, shall be of no force or effect.
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
In the event of a conflict between the terms contained herein and the Waiver, the terms of the Wavier shall govern.
